These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and FundamIT LLC ("we," "us," "our," or "Company"), governing your access to and use of the BookATee platform at bookatee.net and all associated subdomains (the "Service").
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
BookATee is a cloud-based software-as-a-service (SaaS) platform that provides golf course and simulator facility management tools, including but not limited to:
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. The Service is intended for use by golf course operators, simulator facility owners, and authorized personnel.
You are responsible for:
Upon registration, you will receive a subdomain (e.g., yourcourse.bookatee.net). Subdomains are assigned on a first-come, first-served basis. We reserve the right to reclaim subdomains that are inactive, infringing, or in violation of these Terms.
The Service is offered under tiered subscription plans (Basic, Pro, Enterprise, and Simulator tiers) with varying features and pricing. Current plan details and pricing are available at bookatee.net/pricing.html.
New accounts receive a 14-day free trial. A valid payment method is required at signup. You will not be charged during the trial period. If you cancel before the trial ends, you will not be charged.
Your subscription rate is locked for the first 12 months of service. After the initial term, we may adjust pricing with at least 30 days' written notice. Promotional discounts apply to the first year only unless otherwise stated.
If a payment fails, we will attempt to charge your payment method again. After repeated failures, your account may be suspended. A 30-day grace period is provided before account data is affected.
You may cancel your subscription at any time from your admin dashboard under Settings → Billing. Upon cancellation:
We do not provide refunds for partial billing periods. If you cancel mid-cycle, you retain access for the remainder of that cycle. Refund requests for exceptional circumstances may be submitted to info@bookatee.net and will be reviewed on a case-by-case basis.
After cancellation, your account data will be retained for 90 days to allow for reactivation. After 90 days, data may be permanently deleted. You may request early deletion by contacting us.

We reserve the right to suspend or terminate accounts that violate these restrictions.
You retain ownership of all data you submit to the Service ("Customer Data"), including member records, booking data, and configuration settings. You grant us a limited license to host, store, and process your data solely to provide the Service.
You may export your data at any time through the admin dashboard. Upon account termination, we will make your data available for export for 90 days.
We protect your data through encryption, access controls, and database-level tenant isolation as described in our Privacy Policy. You are responsible for complying with applicable data protection laws regarding the personal information of your customers and members.
BookATee integrates with Stripe for payment processing. By using payment features, you also agree to Stripe's Terms of Service. We are not responsible for payment processing errors or disputes handled by Stripe. Golf course operators using Stripe Connect for booking payments are responsible for their own Stripe account setup and compliance.
If you use the SMS notification feature:
We reserve the right to suspend SMS features if misuse is detected.
The Service, including its design, code, features, documentation, and branding, is owned by FundamIT LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
The "BookATee" name, logo, and associated marks are trademarks of FundamIT LLC.
The Service integrates with third-party services including Stripe, Twilio, Open-Meteo, and AWS. Your use of these services is subject to their respective terms. We are not liable for the actions, availability, or data practices of third-party providers.
We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

TO THE MAXIMUM EXTENT PERMITTED BY LAW:
You agree to indemnify and hold harmless FundamIT LLC, its officers, directors, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

Upon termination, your right to use the Service ceases immediately. Sections related to data ownership, limitation of liability, indemnification, and governing law survive termination.
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Washington County, New York, under the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable or invalid, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and FundamIT LLC regarding the Service, superseding any prior agreements or communications.
